WaitLess is an online healthcare information and discovery platform designed to help users find and compare healthcare providers and specialist healthcare services. WaitLess is not a medical practice, healthcare provider, booking service or emergency medical service.

Do not submit your medical information to WaitLess. You do not need to provide, enter or upload your medical history, diagnosis, symptoms, Medicare details, referral documents or any other health information when using WaitLess to search for healthcare providers.

If you choose to contact a healthcare provider directly, we encourage you to review the provider’s privacy policy before submitting any personal information. Any information you provide to that provider will be collected, used, disclosed, and otherwise handled by the provider in accordance with its own privacy obligations and privacy policy.

2. Information we may collect

We generally do not request personal information from visitors to our website. However, if you choose to contact us, we may collect information you provide in your communications with us, such as your name, email address, contact details, and the content of your enquiry.

Depending on how you interact with WaitLess, we may collect limited information relating to your use of our website and platform, including:

You should not  submit your diagnosis, symptoms, medical history, medications, pathology results, Medicare details, referral documents or other clinical or health information through general contact forms, emails, feedback forms or other communications with WaitLess.

If sensitive information is inadvertently provided to us, and we determine that it is not reasonably necessary for our functions or activities, we will take reasonable steps to securely delete, de-identify, or destroy that information, unless retention is required by law.

4. Information about healthcare providers

WaitLess may display information about healthcare providers, clinics and specialist services.

This information may be obtained from:
- healthcare providers and clinics;
- publicly available sources;
- healthcare provider websites;
- publicly available professional registers;
- information supplied directly to WaitLess; and
- other legitimate third-party sources.

Information may include practitioner names, specialties, clinic locations, services offered, contact details, fees, availability information and other professional information relevant to helping users identify and connect with healthcare providers.

WaitLess takes reasonable steps to ensure that healthcare provider information displayed on the platform is accurate, complete and up to date. However, information may change over time, and healthcare providers remain responsible for the accuracy and currency of information they provide to WaitLess. Users should confirm relevant details directly with the healthcare provider before relying on them.

5. How we collect information

We may collect information:
- when you contact or otherwise communicate with us;
- when you access or use our website or platform;
- from healthcare providers;
- from publicly available sources; and
- through cookies, analytics services and similar technologies.

6. How we use information

We may use information to:
- operate, maintain and improve the WaitLess website and platform;
- respond to enquiries and provide support;
- understand how users interact with our website and services;
- maintain the security, integrity and functionality of our systems;

We do not sell or otherwise commercially disclose personal information.

8. Direct marketing

If you choose to subscribe to updates from WaitLess, we may send you information about WaitLess, including  service updates, new features and related marketing communications. .

You can unsubscribe from marketing communications at any time using the unsubscribe option provided or by contacting us. We will only send marketing communications where we have your consent or are otherwise permitted by law.

9. Data security

We take reasonable steps to protect personal information against misuse, interference, loss and unauthorised access, modification or disclosure.

However, no website, internet transmission or electronic storage system can be guaranteed to be completely secure. As WaitLess does not require health information or other sensitive personal information to operate its website or platform, users  should not submit such information through email, contact forms or other general communication channels.

10. Data retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected.

When information is no longer reasonably required, we will take reasonable steps to securely delete, destroy or de-identify it, unless we are required or authorised to retain it by law.

11. Overseas service providers

WaitLess may use third-party service providers, including website hosting, cloud storage, analytics and technology providers, that store or process information outside Australia. 

As a result, information collected through the WaitLess website and platform may be transferred to, stored in, or processed in countries outside Australia. The countries in which information is stored or processed may change from time to time as our service providers and technology arrangements change. 

Where we engage overseas service providers, we will take reasonable steps to ensure that information is handled securely and in a manner consistent with this Privacy Policy.

We may update this Privacy Policy from time to time to reflect changes to our business, website, technology or legal obligations.

The latest version will be published on the WaitLess website and will include the date it was last updated.

WaitLess Health ("WaitLess") provides information to help users discover healthcare providers and specialist healthcare services. WaitLess is not a medical practice, healthcare provider, doctor, specialist, hospital, emergency medical service, booking or referral service.

Information only

Information displayed on WaitLess may include healthcare provider names, specialties, locations, services, fees, contact details, availability information, estimated wait times and other information relating to healthcare providers.

This information is provided for general information and healthcare-access purposes only. Information may be supplied by healthcare providers, obtained from publicly available sources or provided by third parties. While WaitLess takes reasonable steps to maintain the accuracy of information displayed on the platform, we do not warrant or guarantee that any information  is complete, accurate, current or free from errors.

Healthcare provider details, service availability, fees and estimated wait times can change without notice. Users should verify important information directly with the relevant healthcare provider before relying on it.

Availability and wait times

Any availability or wait-time information displayed on WaitLess is indicative only unless expressly stated otherwise.

Information about appointment availability and estimated wait times is provided for convenience and may change without notice. The display of timeframe or availability information  on WaitLess does not constitute confirmation or guarantee of an appointments.

You should contact the relevant healthcare provider directly to confirm:
- current availability;
- appointment times;
- fees;-referral requirements;
- practitioner availability;
- services offered; and
- any other information relevant to your healthcare needs.

No medical advice

WaitLess does not provide medical advice, diagnosis,  treatment, healthcare services, booking or referral services.The information made available on WaitLess is provided for general informational and healthcare-access purposes only and is  not a substitute for professional medical advice from a qualified healthcare professional.

WaitLess does not assess symptoms, medical history or individual circumstances and does not recommend, endorse or determine the clinical suitability of any healthcare provider, treatment or service.

You are solely responsible for selecting a  healthcare provider and determining whether a provider or service is appropriate for your needs. You should  seek advice from a qualified healthcare professional regarding your individual circumstances and healthcare decisions.

No endorsement

The inclusion of a healthcare provider on WaitLess does not constitute an endorsement, recommendation, accreditation or guarantee by WaitLess.

Healthcare providers listed on WaitLess are independent third parties. WaitLess does not verify or guarantee the quality, safety, suitability, qualifications, conduct, treatment, services or outcomes of any healthcare provider.

Third-party healthcare services

Any healthcare services accessed oridentified using WaitLess are  provided by the relevant healthcare provider, not by WaitLess.

WaitLess does not control or accept responsibility for:
- clinical decisions, advice or treatment;
- appointment availability, scheduling, cancellations or outcomes;
- fees, billing practices or referral requirements;
- practitioner conduct or professional standards; or
- the quality, safety or suitability of healthcare services provided.

Any concerns, complaints or dispute relating to a healthcare provider or healthcare service should be directed to the relevant healthcare provider or applicable regulatory authority.

Medical emergencies

WAITLESS IS NOT AN EMERGENCY MEDICAL SERVICE AND DOES NOT PROVIDE EMERGENCY MEDICAL ASSISTANCE. 

If you or another person is experiencing a medical emergency, call 000 immediately or attend your nearest emergency department.

Do not use WaitLess to seek emergency medical assistance, obtain urgent medical advice, or determine whether your situation is an emergency.

Website and technical availability

We aim to keep WaitLess available, secure and functioning properly, but we do not guarantee that the website or platform will always be available, uninterrupted, secure or error-free.WaitLess may modify, suspend, restrict or discontinue any part of the website of platform at any time without notice.

Limitation of liability

To the maximum extent permitted by law, WaitLess is not liable for any direct, indirect, incidental, consequential or special  loss, damage, cost or expense arising from or in connection with:
-The use of, or inability to use, WaitLess;
- Reliance on information displayed on WaitLess;
- Inaccuracies, omissions or changes in healthcare services provided by third parties; or
- The use of third-party websites, booking platforms or services.

Nothing in this Disclaimer excludes, restricts or modifies any right, guarantees, warranty or remedy that cannot lawfully be excluded, restricted or modified under applicable law.

These Terms & Conditions ("Terms") govern your access to and use of the WaitLess Health website, platform and related services ("WaitLess", "Platform", "we", "us" or "our").By accessing or using WaitLess, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.These Terms apply to both individuals using WaitLess to find healthcare services and healthcare providers, clinics and other organisations that create, claim, manage or promote listings on the Platform, except to the extent that a separate written agreement applies.

1. What WaitLess does

WaitLess is an online healthcare information, discovery and comparison platform. WaitLess is designed to help users discover and compare healthcare providers and healthcare services using information made available through the Platform.

WaitLess is not:
- a medical practice
- a healthcare provider
- a doctor, specialist or other health practitioner
- an emergency service
- a clinical triage service
- a medical advice service
- a diagnostic service or
- a healthcare appointment or booking provider, unless a particular feature expressly states otherwise.

WaitLess does not diagnose, assess, treat or provide medical advice to users.Information available through WaitLess is intended to assist users in finding and comparing healthcare services. It should not be relied upon as a substitute for professional medical advice or assessment.

2. Eligibility and permitted use


You may use WaitLess only for lawful purposes and in accordance with these Terms.

You must not use WaitLess:
- for any unlawful, fraudulent or deceptive purpose
- to provide false, inaccurate or misleading information
- to impersonate another person, healthcare provider or organisation
- to interfere with or disrupt the operation or security of the Platform
- to attempt to gain unauthorised access to the Platform, our systems or another user's account
- to introduce viruses, malware or other harmful code
- to scrape, harvest, reproduce or systematically copy Platform content without our prior written permission
- to collect, use or disclose information about another person without proper authority
- to send spam or unsolicited commercial communications
- to manipulate search results, rankings, reviews, availability information or other Platform data
- to misuse provider information or contact details
- to use the Platform to provide medical advice or clinical recommendations to another person
- to interfere with healthcare providers' businesses or operations
- or in any manner that may harm WaitLess, a healthcare provider, a patient, a user or another person.

We may take reasonable steps to prevent or restrict activity that we believe breaches these Terms or may compromise the Platform or its users.

3. Healthcare information is general information only


Information provided through WaitLess is general information intended to assist users in locating and comparing healthcare services.

Nothing on the Platform constitutes:
- medical advice
- diagnosis
- treatment advice
- clinical assessment
- a referral
- a clinical recommendation or
- a guarantee that a particular healthcare provider or service is appropriate for you.

WaitLess does not assess your symptoms, medical history, diagnosis, medical records, clinical circumstances or individual healthcare needs.

You are responsible for obtaining appropriate advice from a suitably qualified healthcare professional before making healthcare decisions.Where appropriate, you should independently verify information about a healthcare provider, including qualifications, registration, services, fees and suitability.

4. No patient health information required

WaitLess is designed to allow users to search for and discover healthcare providers without needing to provide medical or health information to WaitLess.

You should not submit unnecessary sensitive or health information through general WaitLess search fields, enquiry forms, emails or other communications.

This includes, where unnecessary
- symptoms
- diagnoses
- medical history
- medical records
- pathology or imaging results
- Medicare information
- referral documents and
- other sensitive health information.

If you choose to provide health information directly to a healthcare provider after leaving WaitLess, that information will be handled by the relevant healthcare provider in accordance with that provider's own privacy obligations and policies.Our handling of personal information is also subject to our Privacy Policy.

5. Healthcare provider information

Information displayed on WaitLess may be supplied by healthcare providers, clinics or other organisations, or obtained from publicly available, licensed or third-party sources.

Information may include:
- practitioner names
- professions and specialties
- qualifications and registration information
- clinic and practice locations
- healthcare services
- fees and pricing information
- contact details
- opening hours
- appointment availability
- estimated wait times
- accessibility information
- practitioner or clinic descriptions and
- other professional or business information.

We take reasonable steps to maintain the quality and accuracy of information on the Platform. However, healthcare information can change frequently and information supplied by third parties may contain errors or omissions.To the maximum extent permitted by law, WaitLess does not guarantee that information on the Platform is complete, accurate, current, suitable or error-free.Where information is important to your healthcare decision, you should confirm it directly with the relevant healthcare provider.

6. Availability, appointments and estimated wait times

WaitLess may display information concerning appointment availability, estimated waiting periods or other indicators of access to healthcare services.

This information may change at any time and may depend on information supplied by a healthcare provider or another third party.Unless WaitLess expressly states otherwise, availability, wait times and similar information are indicative only and are not guaranteed.

A displayed appointment time, waiting period or availability indicator does not guarantee that:
- an appointment will remain available
- a provider will accept a new patient
- a provider will have capacity at the displayed time
- the displayed wait time will be accurate or you will receive treatment within a particular period.

You should confirm current availability directly with the relevant healthcare provider.

7. Contacting and booking with healthcare providers

WaitLess may provide telephone numbers, email addresses, website links, booking links or other methods of contacting healthcare providers.

Unless a particular WaitLess feature expressly states otherwise, WaitLess does not make, confirm or manage appointments on your behalf.When you contact or book with a healthcare provider, your relationship is directly with that healthcare provider.

The healthcare provider is responsible for:
- accepting or declining appointments
- appointment scheduling
- fees and payment arrangements
- cancellations and rescheduling
- the services it provides
- clinical care and treatment
- patient communications and
its own privacy and regulatory obligations.

Any booking or appointment made through a third-party booking system is subject to that provider's and/or booking platform's terms.

8. Healthcare provider and clinic listings


Healthcare providers, clinics and other organisations may create, claim, update or request changes to their WaitLess listings.

A healthcare provider or clinic that supplies information to WaitLess is responsible for ensuring that information it provides:
- is accurate and current
- is not false, misleading or deceptive
- does not improperly imply qualifications, registration or specialist status
- complies with applicable advertising and professional requirements and
- does not infringe another person's rights.

Healthcare providers must promptly notify WaitLess if material information displayed on their listing becomes inaccurate or misleading.

WaitLess may, where reasonably necessary:
- review information
- request supporting information
- edit formatting or presentation
- reject submitted content
- suspend a listing
- restrict a listing's visibility
- correct information or
- remove a listing or content.

This may occur where we reasonably believe information is inaccurate, misleading, inappropriate, unlawful, unsafe or inconsistent with our policies.

9. Healthcare advertising and promotional content

WaitLess may receive payment from healthcare providers or other organisations for listing, subscription, promotional, advertising or related services.

Payment for a listing or promotional service does not entitle a provider to publish information that is false, misleading, deceptive, unlawful or otherwise prohibited by applicable law.

Where WaitLess publishes or controls advertising for a regulated health service, we may apply requirements designed to support compliance with applicable Australian advertising laws and professional requirements.

This includes applicable requirements under the Health Practitioner Regulation National Law (WA), Ahpra and relevant National Board advertising guidelines, the Australian Consumer Law and other applicable legislation.

Healthcare providers remain responsible for ensuring that information, claims, offers, qualifications, credentials and advertising content they provide to WaitLess comply with applicable laws, regulations, professional standards and registration requirements.

WaitLess may refuse, modify, suspend or remove advertising or promotional content where we reasonably believe it may be unlawful, misleading, unsafe or otherwise inappropriate.

In particular, provider content must not improperly:
- claim or imply specialist registration or qualifications
- make misleading clinical or therapeutic claims
- create an unreasonable expectation of beneficial treatment
- use prohibited testimonials or purported testimonials
- encourage unnecessary or indiscriminate use of regulated health services or
- use protected professional titles incorrectly.

Applicable advertising requirements can apply to businesses and other advertisers, not only registered practitioners.

10. Search results and rankings


WaitLess may use various factors to determine search results, listings, recommendations, sorting or display order.

These factors may include:
- location
- healthcare service or specialty
- relevance to a user's search
- availability information
- information quality
- completeness of a listing
- provider or clinic preferences
- Platform features
- commercial arrangements and
- other technical or business criteria.Search results and rankings are intended to assist discovery only.

A provider appearing higher in search results does not mean that the provider is:
- clinically superior
- safer
- more qualified
- more experienced
- more suitable for you or
- recommended by WaitLess.

Where WaitLess provides paid or promotional placement, we may identify or distinguish that placement where required by law or where appropriate for transparency.

11. No endorsement or accreditation

A listing, search result or profile on WaitLess does not constitute an endorsement, recommendation, accreditation, certification or guarantee by WaitLess.

Unless expressly stated otherwise, WaitLess does not independently verify every statement, qualification, service description, fee, availability indicator or other item of information supplied by a healthcare provider or third party.

Users are responsible for making their own decisions about which healthcare provider or service to contact.

12. Third-party websites, booking systems and services

WaitLess may contain links to healthcare provider websites, booking platforms, directories, payment services and other third-party websites or services.

Third-party services are outside our control.Your use of a third-party website or service is subject to the terms, conditions and privacy policy of the relevant third party.

To the maximum extent permitted by law, WaitLess is not responsible for:
- third-party websites
- third-party booking systems
- third-party appointment availability
- third-party fees or charges
- third-party privacy practices
- third-party security practices
- third-party technical failures
- information supplied or published by third parties or
- healthcare services, treatment or outcomes provided by third parties.

13. Healthcare provider subscriptions and paid services


WaitLess may offer healthcare providers paid subscriptions, premium listings, promotional placements, advertising services or other commercial services.

The applicable price, billing period, inclusions, renewal arrangements and cancellation terms will be disclosed before purchase or set out in a separate commercial agreement.

Unless otherwise agreed, fees are payable in accordance with the applicable subscription or commercial terms.WaitLess may change pricing for future subscription periods by providing reasonable notice.If a separate written commercial agreement exists between WaitLess and a healthcare provider, that agreement will prevail over these Terms to the extent of any inconsistency.

Nothing in this section limits any rights or remedies that cannot legally be excluded under applicable law.

14. Founding Partner Programme

WaitLess may invite selected healthcare providers to participate in a complimentary or discounted founding partner programme.

Unless otherwise agreed in writing, a founding partner arrangement:
- applies only for the period specified by WaitLess
- does not guarantee continued complimentary access
- may be subject to eligibility requirements
- may be withdrawn where reasonably necessary
- does not guarantee any particular search ranking or volume of enquiries and
- may convert to a paid subscription if the provider agrees to continue under applicable subscription terms.

Any special pricing, benefits or commercial arrangements applying to a founding partner will be confirmed separately with the relevant provider.

15. Healthcare provider content


Healthcare providers may submit or provide descriptions, photographs, logos, trade marks, practitioner information and other content for publication on WaitLess ("Provider Content").

By providing Provider Content, the provider confirms that:
- it owns or has permission to use the content
- publication of the content does not infringe another person's intellectual property, privacy or other rights
- the content is accurate and not misleading and
- it has obtained all necessary consents and permissions.

The provider grants WaitLess a non-exclusive, royalty-free, worldwide licence to use, reproduce, communicate, display, format, adapt and modify Provider Content to the extent reasonably necessary to operate, maintain, market and promote WaitLess.

The licence continues for as long as reasonably necessary for these purposes, subject to any separate written agreement between the parties.

16. Intellectual property

Unless otherwise stated, WaitLess owns or licenses the intellectual property associated with the Platform.

This may include:
- the WaitLess name and branding
- logos and trade marks
- software and technology
- website design
- graphics
- written content
- databases
- search functionality
- page layouts and other Platform materials.

You must not copy, reproduce, modify, distribute, publish, sell, licence, commercially exploit or create derivative works from WaitLess intellectual property without our prior written permission, except where permitted by law.

Nothing in these Terms transfers ownership of WaitLess intellectual property to you.

17. Reporting inaccurate or inappropriate informationIf you believe information displayed on WaitLess is inaccurate, outdated, misleading, unlawful or otherwise inappropriate, please contact us.

We may investigate reported information and, where appropriate, correct, update, restrict, suspend or remove the relevant information.

Reports should include enough information for us to identify the listing or content and understand the issue.

18. Suspension and termination

We may suspend, restrict or terminate your access to WaitLess where we reasonably believe that you have:
- breached these Terms
- provided false or misleading information
- misused the Platform
- attempted to compromise Platform security
- created a legal, regulatory or security risk
- infringed another person's rights or engaged in conduct that may harm WaitLess, a healthcare provider, a user or another person.

We may also modify, suspend or discontinue the Platform, or any part of it, at any time.

Where reasonably practicable, we may provide notice before taking action, but we may act immediately where we consider this necessary for legal, security, safety or operational reasons.

19. Disclaimer

To the maximum extent permitted by law, WaitLess does not warrant or guarantee that:
- information on the Platform will always be accurate, complete or current
- provider information will remain unchanged
- availability or estimated wait times will be accurate
- a healthcare provider will accept new patients
- an appointment will be available
- a particular provider will be suitable for your needs
- a third-party website or booking system will function correctly
- information supplied by a third party will be accurate
- the Platform will always be available
- the Platform will be uninterrupted, secure or error-free or
- use of the Platform will result in any particular healthcare outcome.

Nothing in these Terms is intended to exclude, restrict or modify a right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified.

20. Liability

To the maximum extent permitted by law, and subject to any rights that cannot lawfully be excluded or limited, WaitLess is not liable for loss, damage, cost or expense arising from or connected with:
- inaccurate, incomplete or outdated provider information
- changes to appointment availability
- reliance on estimated wait times
- decisions made by users based on Platform information
- interactions between users and healthcare providers
- healthcare services or treatment provided by third parties
- appointments made with third parties
- fees or charges imposed by healthcare providers
- third-party websites, booking systems or services
- interruptions, outages or technical problems affecting the Platform or
- unauthorised access to information despite reasonable security measures.

To the extent permitted by law, WaitLess excludes liability for indirect, incidental, special or consequential loss.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or other applicable legislation.

Where the law permits a liability to be limited, our liability will be limited to the maximum extent permitted by law.

The Australian Consumer Law provides consumer guarantees that cannot simply be excluded by contractual wording.

21. Your responsibilities

You are responsible for:
- assessing whether information available through WaitLess is suitable for your purposes
- confirming important information directly with the relevant healthcare provider
- obtaining appropriate professional medical advice
- providing accurate information when communicating with healthcare providers
- complying with the terms of any third-party service you use
- keeping your account or access credentials secure, where applicable and
- making your own healthcare decisions.You must not rely solely on WaitLess to determine whether you require medical attention or which healthcare service is appropriate for your circumstances.

22. Medical emergencies

WAITLESS MUST NOT BE USED FOR MEDICAL EMERGENCIES.

If you or another person is experiencing a medical emergency, call 000 immediately or attend the nearest emergency department.

WaitLess does not monitor the Platform for medical emergencies and cannot provide emergency assistance, clinical triage or urgent medical care.

Do not use WaitLess to delay seeking emergency medical assistance.

23. Australian Consumer Law and other mandatory rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified under:
- the Australian Consumer Law
- the Competition and Consumer Act 2010 (Cth)
- applicable Western Australian legislation or
- any other applicable law.

If a provision of these Terms would otherwise have that effect, that provision will apply only to the maximum extent permitted by law.

24. Privacy

Your use of WaitLess is also subject to our Privacy Policy.

Our Privacy Policy explains how WaitLess collects, uses, stores and discloses personal information and how you can contact us about privacy matters.

Where applicable, WaitLess will handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Private-sector health service providers are also subject to the federal Privacy Act, although WaitLess's obligations depend on the nature of the information it collects and its activities.

25. Changes to these Terms

We may update these Terms from time to time.

When we update the Terms, we will publish the latest version on the WaitLess website and update the "Last updated" date.

Where required by law, we will provide additional notice of material changes.

Your continued use of WaitLess after updated Terms are published constitutes acceptance of the updated Terms to the extent permitted by law.

26. Governing law and jurisdiction


These Terms are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia.

Subject to any mandatory rights or remedies available under applicable law, you submit to the jurisdiction of the courts of Western Australia and courts exercising appellate jurisdiction from them in relation to matters arising out of or connected with these Terms.

Nothing in this clause limits any right you may have to bring proceedings in another jurisdiction where that right cannot lawfully be excluded.

27. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary or, if it cannot be read down, severed from these Terms.

The remaining provisions will continue in full force and effect.

28. No waiver

A failure or delay by WaitLess to exercise a right or remedy under these Terms does not constitute a waiver of that right or remedy.

A waiver is effective only if given expressly and in writing.

29. Entire agreement

These Terms, together with any applicable Privacy Policy, commercial agreement, subscription terms or other terms expressly incorporated by reference, constitute the agreement between you and WaitLess concerning your use of the Platform.

If you are a healthcare provider and have entered into a separate written commercial agreement with WaitLess, that agreement will prevail to the extent of any inconsistency.
